CAPS Questions and Answers:

Q:    What risk do I take by using CAPS instead of regular WC?

A:  CAPS is regular, statutory Workers Compensation -- plus!   There is no risk because you still have the same exact WC insurance you always had (or should have had!).  You just pay less, and your IC's sign up for CAPS accident benefits.  If despite all the program's safeguards, an IC driver still makes a WC claim against you, your insurance will respond just as it does now -- just as the law requires.

Q:    How does this program eliminate Workers Comp. Claims?

A:  It's simple!  Contractors have no reason to make a workers compensation claim because they are well protected by their own (CAPS) benefit plan.  Their policy excludes injuries covered by Workers  Compensation, so they jeopardize their benefits by making a claim.  There is no opportunity play games since the same carrier supplies both policies.  Why would any contractor choose the costs and delay involved in pursuing a Workers Comp. claim against you?

Q:    If I have a great Workers Comp. rate, can CAPS help me?

A:  Yes, this program offers two significant advantages. First, you still save all the Workers Comp. premiums you now pay for contractors. True, contractors will bear some cost, but you can use some of your savings to boost commission rates, attract better drivers, and help them pay for their Occupational Accident benefits.

Second, CAPS eliminates Workers Comp. claims by contractors. Your experience modifier improves and your premiums remain low over the long run. With any other WC policy, unexpected losses can create an adverse modifier, raising your costs for years to come.

Q:   I don’t pay Workers Comp. for my IC’s now. 
        Why do I need this program?

A:  If you do not report contractors to your Workers Compensation carrier, then you are taking a tremendous risk. The law normally allows insurance companies to charge for contractors who do not have their own Workers Compensation.  When your carrier “discovers” your IC's  during an audit or because of a claim, you can be held liable for three years of unpaid premiums at unfavorably high rates.

The CAPS program eliminates your risk because your carrier knows about your contractors and agrees up-front not to audit.  Contractors gain benefits similar to Workers Comp. at a more affordable cost.

Q:   How much does this program cost?

A:  Our Workers Compensation policies cost  as little as $750 per year!  Discounts may apply and your experience modifier remains valid.  Of course, if you have a high "mod," you really come out ahead since it will now apply to a much-reduced payroll base!

The IC drivers’ benefits cost only $10-$15 dollars per week — even less for part-timers!  Also, nothing prevents you from charging for your administrative services as the program sponsor.

Q:   Must all of my contractors sign up?

A:  In order to qualify for full Workers Compensation protection,  you must require all of your contractors to provide evidence of Occupational Accident coverage or a combination of life, health, and disability insurance.  In keeping with contractor status, they may obtain coverage however they choose, but the CAPS policy is superior to anything they can find on their own (click here for tips on presenting CAPS to drivers).  Contact KBS for info. on other, voluntary options.

Q:   How do I get started?

Presenting CAPS to your IC Drivers:

The Courier Accident Protection System (CAPS) revolutionizes the way courier
companies and their affiliated independent contractors manage medical and
disability issues. Contractors who never before had access to benefits will now
enroll in a low-cost, comprehensive Occupational Accident plan. You benefit as
well by paying lower Workers Comp. premiums.

Administering CAPS is easy (we have a Guide for that too!). Presenting CAPS
to drivers, who may tend to resist any new cost or change, can seem like a ‘tough sell.’

Our experience has shown that you can get most drivers to appreciate CAPS’
benefits and value. Companies have succeeded using different approaches, but
the following tips have generally proven effective.

1. Scout out Attitudes:

Consult with a few veteran drivers whom you trust to gauge overall
receptiveness to the program. Promise & request confidentiality.
Practice your ‘presentation’ one-on-one. Do not be discouraged by
a negative response and do not try too hard to ‘win the argument.’
This is just the first step. You can now prepare for objections and how
to overcome them.

2. Call a Meeting:

While you should not ‘force’ independent contractors to meet, adopt a
firm tone. Let it be known that the meeting will address possible new
conditions of contract and exciting benefit opportunities. Everyone may
have to enroll whether they attend or not, and this is their opportunity to
listen and have their opinions heard.  Perfect attendance is not necessary.

3. The Presentation:

Aim to convey firmness of purpose without seeming impervious to their
concerns.  In essence your decision is ‘all but made-up’ but you will
consider all feedback.  Explain the “who, what, how, and why” of the
program.  The ‘who’ is all contractors, who must either show proof of
medical, disability and life benefits or enroll in CAPS.  The ‘what’ is a
low-cost, comprehensive benefits program for on-the-job injuries that
you have found for them and which they can access as IC’s.  Save the
benefit details for later.  The ‘how’ involves regular ‘payroll’ deductions
— no money down.  Mention the rates (get it over with!), which are after
all much lower than individual plans.  Then move onto the ‘why’.

4. The ‘Why’ — Reasons Your Company is Interested

Begin with your concern for the drivers' welfare, but include a ‘selfish’
reason -- or they won’t believe you!

“You drivers need protection in case of injury while making a delivery.
Many of you have no protection at all and this is not right.  Some of you may 
have Major Medical coverage.  Much of this insurance excludes work-
related injuries, and it certainly does not give disability (lost income), 
paralysis, dismemberment, or death benefits.”

“While Auto insurance coverages such as Medical Payments or No-Fault 
Personal Injury Protection will pay for some medical bills in an auto accident, 
its protection is limited - especially for disability (lost income) and death.  In addition, an injury not related to an auto accident would not be covered at all.
This could include loading and unloading, an accident on the loading dock
or at the pickup or delivery premises, or just walking back to the vehicle.”

“Selfishly, we the courier company are better off if you the contractors are 
covered.  More and more often customers want to know if delivery persons 
are protected. They worry that they could be held liable if you have nowhere 
else to go.”
